Postnuptial Agreement

Also known as a “postnup”, postnuptial agreements are similar to prenuptial agreements but are done so after marriage but before divorce. While discussion of a divorce is not necessary for a postnuptial agreement, they can assist in the division of assets if a divorce were to occur. Common triggers for creating a postnuptial agreement are when a spouse inherits large property, debt, or is going to start a business. Like prenuptial agreements, it is important to have independent counsel to consult to ensure education on the law and how the agreement could affect you in the future.
